OLAR AI LLC

OLAR AI Terms of Service

OLAR AI Terms of Service

1. About these Terms

1. About these Terms

These Terms of Service govern your use of OLAR AI’s websites and learning application, including app.olar.ai (the “Services”). The Services are provided by OLAR AI LLC, a California limited liability company (“OLAR AI,” “we,” “us” or “our”).

Please read these Terms before creating an account or purchasing a subscription. When you accept these Terms through our account or purchase process, you agree to them. If you do not agree, do not create an account or use the Services.

If you enter into an agreement on behalf of an organisation, you must have authority to bind it. A separate written agreement signed by OLAR AI controls over these Terms to the extent it expressly addresses the same subject and conflicts with them.

Nothing in these Terms excludes or limits rights or remedies that applicable law does not allow us to exclude or limit. This includes mandatory consumer protections in your country of residence.

2. What OLAR AI provides

2. What OLAR AI provides

OLAR AI provides AI-assisted learning tools for mathematics and physics. Features may include uploading problems, writing working on a digital whiteboard, handwriting recognition, feedback on individual steps and symbols, and saving learning activity.

Available features, usage allowances and subscription options are described in the Services and at checkout. An account or subscription does not include features that we have only announced or are still developing.

OLAR AI supports learning. It is not an accredited school, a teacher of record, an examination service or a substitute for professional judgement. It does not provide medical, legal, financial or other regulated professional advice, or emergency assistance.

3. Eligibility and younger users

3. Eligibility and younger users

You must be at least 13 years old to use OLAR AI. Children under 13 may not create an account or use the Services, including through a parent’s account.

If you are under 18, or otherwise below the age at which you can independently enter into this agreement where you live, you may use the Services only where local law permits and with the permission and supervision of a parent or legal guardian. Your parent or guardian should review these Terms and our Privacy Policy with you. Where the law requires their agreement or consent, that requirement must be satisfied before you use the relevant Services.

A parent or guardian’s permission does not override a legal age restriction. You must provide accurate age information and must not misrepresent your age to bypass restrictions.

The person authorising a purchase must have legal capacity to do so and permission to use the payment method. A school or teacher’s recommendation does not by itself create an institutional agreement with OLAR AI or authorise the use of another person’s information.

4. Your account

4. Your account

Provide accurate account information and keep it up to date. Keep your login credentials secure and do not share your account, sell access to it or let another person impersonate you.

You are responsible for your own use of the Services and for taking reasonable steps to protect your account. This does not make you responsible for unauthorised activity caused by our failure to meet our legal obligations.

If you suspect unauthorised access, contact official@olar.ai promptly. We may require reasonable verification before changing account ownership, disclosing account information or acting on a deletion request.

5. Plans and usage limits

5. Plans and usage limits

OLAR AI offers Free and Pro plans. Your plan’s features, limits, billing interval and price are those disclosed when you sign up or purchase, subject to changes permitted by these Terms and applicable law.

Usage limits and technical safeguards may restrict requests, uploads or AI processing. Do not create additional accounts or otherwise circumvent those limits. Unless your offer expressly states otherwise, unused usage allowances have no cash value and do not carry over.

We may temporarily limit processing to address abuse, security incidents or service capacity. Paid subscriptions remain subject to the remedies described in these Terms and applicable law; a technical limit does not remove those rights.

6. Prices, payment and automatic renewal

6. Prices, payment and automatic renewal

Paid subscriptions are processed through Stripe. Before you purchase, checkout identifies the price, currency, billing interval, applicable taxes and any trial or promotional conditions. You must be authorised to use the payment method you provide.

A recurring subscription renews automatically at the end of each billing period until cancelled. When you expressly authorise a recurring subscription at checkout, you authorise charges to your payment method for the amounts and intervals disclosed there, subject to any later price change made in accordance with these Terms and applicable law.

An annual subscription is billed for the annual period even if a price comparison shows an equivalent monthly amount. Promotional prices apply only for the duration disclosed in the offer.

If a payment fails, we may retry collection and ask you to update your payment details. Paid access may be suspended if payment remains outstanding. We will not charge fees that were not disclosed or otherwise permitted by law.

Before an increase applies to an existing recurring subscription, we will provide the notice required by law and a reasonable opportunity to cancel. Where further consent is required, we will obtain it. A price change does not retroactively increase a completed charge.

7. Free trials

7. Free trials

Where offered, OLAR AI’s standard Pro trial lasts three days. The offer and checkout specify your trial’s duration, eligibility, renewal price and billing interval.

If your trial includes automatic conversion to a paid subscription, you will be charged when the trial ends unless you cancel before the stated conversion time. We will disclose those conditions before you enrol and obtain any authorisation required by law.

Cancel through your account’s billing controls before the trial ends to prevent conversion. If the cancellation controls do not work, contact official@olar.ai promptly and retain your message. We will honour a timely cancellation request and correct any resulting erroneous charge.

Trial eligibility and any promotional restrictions will be stated in the offer. A trial does not remove statutory withdrawal or refund rights.

8. Cancelling a subscription or deleting an account

8. Cancelling a subscription or deleting an account

Cancelling renewal

Cancelling renewal

You can cancel renewal through the billing controls in your account or the linked billing portal. You do not need to delete your account to stop renewal.

Cancellation normally takes effect at the end of your current paid period, and you can continue using the remaining paid access until then. For a trial, cancellation before conversion prevents the first subscription charge. Any different effect must be clearly disclosed before you confirm the action and must comply with applicable law.

If you cannot access the cancellation controls, email official@olar.ai for help. We will not make an additional purchase or a retention offer a condition of cancellation.

Deleting your account

Deleting your account

Deleting your account is different from cancelling renewal. Account deletion ends account access, removes account data subject to the retention explained in our Privacy Policy, and is intended to cancel associated active subscriptions immediately. Do not choose deletion if you want to keep using the remainder of a paid period.

Follow the account-deletion process in the Services or contact us for help. Save any work you need before requesting deletion. Deletion is not a promise that every backup or legally required record disappears immediately.

Deleting an account does not automatically generate a refund. Refund and withdrawal rights are described below and remain available where required by law.

9. Refunds and statutory withdrawal rights

9. Refunds and statutory withdrawal rights

Except where required by law, expressly included in an offer, or provided under these Terms, subscription payments are non-refundable and we do not provide prorated refunds merely because you stop using the Services or cancel renewal partway through a paid period.

This does not exclude remedies for an incorrect charge, a service that does not meet mandatory legal requirements, or a material reduction or discontinuation covered by section 15. Contact official@olar.ai with your account email and a description of the issue. Do not send full payment-card details.

If consumer law gives you a cooling-off or withdrawal right, you may exercise it despite the general refund policy above. For example, where the EU or UK statutory withdrawal rules apply to your service contract, the usual withdrawal period is 14 days from entering into the contract. You can notify us by email with a clear statement that you wish to withdraw, identifying your account and purchase.

If you expressly requested that services begin during a statutory withdrawal period, we may deduct a proportionate amount for services supplied before withdrawal only where the law permits and the required disclosures and consents were obtained. Starting to use OLAR AI does not, by itself, waive a statutory withdrawal right. Any exception to that right applies only when its legal conditions are satisfied. We will provide any required refund within the applicable statutory period.

10. Your content and AI output

10. Your content and AI output

Content you provide

Content you provide

“Input” means material you submit, such as problems, handwriting, images, documents, messages and feedback. You retain whatever ownership rights you have in your Input. You must have the rights or permissions needed to submit it and allow us to process it for the purposes described here.

Do not upload another person’s private information without authority or submit material in breach of copyright, confidentiality obligations or your school’s rules. Avoid including personal information that is unnecessary for the learning task.

You grant OLAR AI a non-exclusive, worldwide, royalty-free permission to host, copy, transmit, format and process your Input as needed to provide, secure, support and maintain the Services, and to evaluate and improve their quality as described in our Privacy Policy and permitted by law. We may allow our service providers to perform those activities on our behalf, subject to applicable contractual and legal requirements.

This permission is limited to those purposes. It does not give us ownership of your work or permission to sell it as a standalone product, publish it as a testimonial, or use your name or likeness in advertising without separate permission. It lasts only for as long as the relevant processing is permitted under our Privacy Policy and applicable law, including any lawful retention after account deletion.

Content rights and privacy rights are different. This licence does not replace any lawful basis, consent or other protection required for processing personal information, including children’s information. Quality evaluation may involve human review as described in the Privacy Policy; these Terms do not establish that submitted work is anonymous.

AI-generated output

AI-generated output

“Output” means AI-generated explanations, feedback, annotations and other responses supplied to you through the Services. Subject to these Terms and any third-party rights, you may use Output for your personal learning and other lawful educational purposes.

To the extent OLAR AI holds rights needed for that use, we grant you a non-exclusive, worldwide, royalty-free licence to use Output you received, including after your subscription ends. This does not grant rights in our software, branding or other users’ content.

Output may not be unique, may resemble output supplied to others and may not qualify for copyright protection. We do not promise exclusive ownership, originality or clearance of third-party rights. Check the Output and the rules that apply to your intended use before sharing or submitting it.

11. AI limitations and academic integrity

11. AI limitations and academic integrity

AI and handwriting recognition can make mistakes. OLAR AI may misread symbols, mark a correct step as incorrect, accept an incorrect step or produce an incomplete or misleading explanation. Review important results and check them against reliable sources or a qualified teacher.

We do not guarantee particular grades, examination results, admission outcomes or learning improvements. You remain responsible for deciding how to use the feedback. This does not excuse us from providing the Services with any level of care required by law.

Follow your school’s, teacher’s and examination provider’s rules on AI assistance. Do not use OLAR AI to cheat on an assessment or misrepresent AI-generated work as unaided work where disclosure or independent work is required.

12. Acceptable use

12. Acceptable use

You must not use the Services to:

•

Break the law or infringe another person’s intellectual-property, privacy or other rights.

•

Harass, threaten, exploit or sexually abuse anyone, or create or distribute unlawful sexual content.

•

Submit malicious code, interfere with the Services or access accounts, systems or data without permission.

•

Bypass authentication, safety controls, payment requirements or usage limits.

•

Impersonate another person, misrepresent your age, commit fraud or use stolen payment information.

•

Extract non-public system instructions, credentials, model components or other protected information through unauthorised access or circumvention.

•

Scrape or automate access in a way that bypasses restrictions, compromises security, infringes rights or materially burdens the Services.

•

Resell the Services or provide shared commercial access without our written agreement.

Restrictions on reverse engineering or similar analysis apply only to the extent permitted by law. These Terms do not restrict rights that the law makes non-waivable. Security testing requires our prior authorisation unless applicable law provides otherwise. You may report suspected vulnerabilities to official@olar.ai.

13. Our intellectual property

13. Our intellectual property

OLAR AI and its licensors retain their rights in the Services, including software, interface elements, branding and underlying systems. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Services for their intended educational purposes during your authorised access period.

You may not copy, distribute or commercially exploit those materials beyond this permission or any rights granted by law. Third-party and open-source materials remain subject to their applicable licences.

You may voluntarily send product suggestions. We may use suggestions to improve the Services without paying you, but this does not transfer ownership of your submitted learning content or waive confidentiality or privacy obligations.

14. Privacy and third-party services

14. Privacy and third-party services

Our Privacy Policy explains how we collect, use, disclose and retain personal information, and how to exercise privacy rights. Our Sub-processor List provides information about providers involved in processing customer personal data. Accepting these Terms is not blanket consent to every kind of data processing, tracking or international transfer.

We use third-party providers for functions such as hosting, AI processing, handwriting recognition, payments and security. Some optional services, such as an external sign-in provider, may also have terms governing your separate relationship with that provider. We remain responsible for our own obligations under these Terms and applicable law.

Links to external websites do not mean we endorse them. Review the relevant terms and privacy information before using an independent third-party service.

15. Availability and changes to the Services

15. Availability and changes to the Services

We maintain and update the Services, but interruptions may occur because of maintenance, errors, security events or provider outages. Unless a separate agreement states otherwise, we do not promise uninterrupted availability or a particular service level.

Free, preview and beta features may change or be withdrawn. We will identify a feature as experimental where relevant; experimental status does not remove mandatory consumer rights.

If we discontinue a paid service or materially reduce its principal functionality during a prepaid period, we will give advance notice where reasonably practicable. Unless we restore the affected functionality or you agree to an appropriate alternative, you may cancel the affected subscription and receive a proportionate refund for the unused affected portion. Any stronger rights provided by law remain available.

16. Suspension and termination

16. Suspension and termination

We may restrict, suspend or terminate access where reasonably necessary to address a material breach of these Terms, non-payment, fraud, a security threat, or a legal requirement. Where practicable and appropriate, we will explain the reason and give you an opportunity to resolve the issue. We may act immediately if delay would create a risk or violate the law.

If you believe an action was mistaken, contact official@olar.ai and request a review.

We may also discontinue your access for business reasons with reasonable advance notice. If we terminate a paid service for reasons other than your material breach, we will refund the unused prepaid portion. Termination for breach does not remove any mandatory refund rights.

You can end your use at any time. Cancel recurring subscriptions separately unless you are completing account deletion. Data retention and deletion are governed by the Privacy Policy and applicable law. We do not promise a fixed post-termination export period.

Provisions that by their nature need to survive termination continue to apply, including accrued payment obligations, permitted use of previously received Output, intellectual-property protections, applicable liability limitations and dispute provisions. Content-processing permissions survive only to the limited extent described in section 10.

17. Copyright concerns

17. Copyright concerns

If you believe material available through OLAR AI infringes your copyright, contact official@olar.ai. Identify the copyrighted work, the material you believe infringes it, where we can locate it and your contact information. Include an explanation of your authority to act for the rights holder and any supporting information.

We may request further information, restrict access to reported material and notify the affected user where appropriate and lawful. Please submit accurate reports. This contact route does not imply that OLAR AI has a registered statutory copyright agent.

18. Warranties and liability

18. Warranties and liability

To the extent permitted by applicable law, the Services are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not promise that every error will be corrected or that every Output will be accurate.

Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability to the extent it cannot lawfully be excluded or limited. Statutory consumer guarantees and remedies remain in effect.

Subject to those protections, and to the extent the law permits, neither party is liable to the other for indirect or consequential losses, lost profits or lost business opportunities arising from these Terms. For consumers, this exclusion does not remove a right to recover reasonably foreseeable losses caused by our breach where applicable law protects that right.

Subject to the same protections, OLAR AI’s total aggregate liability arising out of or relating to the Services or these Terms is limited to the greater of US$100 or the amount you paid OLAR AI for the Services in the 12 months before the event giving rise to the claim. This limit applies only where lawful and enforceable and does not override mandatory remedies.

19. Business users’ responsibility for third-party claims

19. Business users’ responsibility for third-party claims

This section applies only if you use the Services in the course of a business or on behalf of an organisation. It does not apply to individual consumers using OLAR AI for personal learning.

To the extent permitted by law, you will indemnify OLAR AI against third-party claims and reasonable resulting costs to the extent caused by your unlawful Input, your infringement of a third party’s rights, or your intentional or negligent material breach of these Terms. This obligation does not apply to the extent a claim results from OLAR AI’s own breach, negligence or misconduct.

We will notify you promptly of a claim, provide reasonable cooperation and allow you reasonable participation in its defence. Neither party may agree to a settlement imposing an admission, payment or ongoing obligation on the other without that party’s written consent, which will not be unreasonably withheld.

20. Governing law and disputes

20. Governing law and disputes

California law governs these Terms, except where mandatory law requires otherwise and without depriving consumers of protections they are entitled to under the law of their country of residence.

If a concern arises, contact official@olar.ai so we can try to resolve it. You do not have to complete an informal process before exercising rights that cannot lawfully be conditioned on it, seeking urgent relief or meeting a filing deadline.

Subject to mandatory consumer jurisdiction rules, disputes may be brought in courts with jurisdiction in California. Nothing in these Terms prevents an eligible small-claims action or a consumer from using a court or complaint mechanism available under mandatory law.

These Terms do not require binding arbitration or waive participation in a class action. They do not shorten statutory limitation periods.

21. Changes to these Terms

21. Changes to these Terms

We may update these Terms to reflect changes in the Services, our business or the law. We will identify the updated and effective dates and provide reasonable advance notice of material changes, except where an urgent legal or security reason requires a shorter period.

Where renewed acceptance is legally required, we will request it. Continued use constitutes acceptance only where applicable law permits and adequate notice has been provided. Changes do not apply retroactively to disputes that arose before the change took effect.

If you do not agree to a change, you may stop using the Services and cancel renewal. Any refund or other remedy required by law or promised under these Terms remains available.

22. General terms

22. General terms

We may send service notices electronically through the Services or to your account email, subject to any legal requirements for consent or a particular delivery method. Keep your contact information current. This does not enrol you in marketing communications or waive a right to paper notices where the law provides one.

These Terms, together with the purchase terms disclosed and accepted at checkout and any applicable separate written agreement, form the agreement governing your use of the Services. Privacy information explains our data practices and does not reduce your statutory rights.

If a provision is unenforceable, the remaining provisions continue to apply to the extent legally possible. A delay in enforcing a provision is not a waiver of it.

We may transfer this agreement as part of a merger, acquisition or sale of the relevant business, provided the transfer does not reduce your mandatory rights. We will provide any notice required by law. You may not transfer your account or agreement without our permission, except where the law allows it.
